Tax professionals, CA Final aspirants, and CFOs can now access comprehensive coverage of cross-border tax concepts, leaving only the procedural compliance modules for the final phase.
1. Executive Summary & Batch Progress Update
Direct Tax laws in India are undergoing unprecedented transformations driven by global tax alignment, digital economy expansion, and statutory modernization. The completion of the International Taxation module marks a significant leap in our curriculum design. Tax practitioners and students preparing for the May/Nov 2027 assessment cycles now have full access to in-depth technical analysis, statutory provisions, landmark judicial precedents, and practical case studies covering cross-border transactions.
With 80% of the syllabus now completed, the remaining 20% will focus strictly on Procedural Law, including assessments, reassessments, appeals, revisions, penalties, and search/seizure mechanics under the Income Tax Act, 1961.
2. Deep Dive: International Taxation Framework (May/Nov 2027 Focus)
International taxation is no longer a peripheral topic; it forms the core of modern corporate tax planning and compliance. Below is an overview of the core statutory structures covered in the newly uploaded module:
A. Non-Resident Taxation & Business Connection (Section 9)
Under Section 9(1)(i) of the Income Tax Act, 1961, income accruing or arising, whether directly or indirectly, through or from any Business Connection in India, or through or from any property or source of income in India, is deemed to accrue or arise in India. The expanded scope of Business Connection now explicitly incorporates Significant Economic Presence (SEP) under Explanation 2A to Section 9(1)(i).
Significant Economic Presence (SEP) constitutes a Business Connection in India if a non-resident engages in:
- Transaction Criterion: Any transaction in respect of goods, services, or property with any person in India exceeding ₹2 Crore in a financial year.
- User Base Criterion: Systematic and continuous soliciting of business activities or engaging in interaction with 3,00,000 or more users in India.
B. Double Taxation Avoidance Agreements (DTAA) & MLI Integration
Section 90 empowers the Central Government to enter into bilateral Double Taxation Avoidance Agreements (DTAAs) with foreign countries. In accordance with Section 90(2), where the Central Government has entered into a DTAA, the provisions of the Income Tax Act apply to the extent they are more beneficial to the assessee.
However, claiming treaty benefits requires compliance with key procedural mandates:
- Tax Residency Certificate (TRC): Non-residents must obtain a valid TRC from their home jurisdiction under Section 90(4).
- Form 10F Electronic Filing: Mandatory electronic submission of Form 10F where specific particulars are not contained within the TRC.
- Multilateral Instrument (MLI) & PPT: Under BEPS Action 15, treaties incorporate the Principal Purpose Test (PPT) to deny treaty benefits if obtaining the tax benefit was one of the principal purposes of an arrangement.
C. Transfer Pricing Mechanism (Sections 92 to 92F)
Cross-border transactions between Associated Enterprises (AEs) must satisfy the Arm's Length Price (ALP) principle under Section 92. The uploaded module delivers exhaustive practical insights on determining ALP using statutory methods under Section 92C:
- Comparable Uncontrolled Price (CUP) Method
- Resale Price Method (RPM)
- Cost Plus Method (CPM)
- Profit Split Method (PSM)
- Transactional Net Margin Method (TNMM)
Special emphasis has been given to maintaining primary transfer pricing documentation under Rule 10D, filing Form 3CEB, and understanding Master File & Country-by-Country (CbC) reporting requirements under Section 286.
The Supreme Court of India held that payments made by Indian end-users/distributors to non-resident computer software manufacturers/suppliers for the use or distribution of software do not constitute 'Royalty' under DTAA provisions. Consequently, no tax is deductible under Section 195 of the Income Tax Act on such transactions where DTAA benefits apply.
D. BEPS Action Plans & Pillar Two (GloBE Rules)
As global economies implement the OECD/G20 Inclusive Framework on Base Erosion and Profit Shifting (BEPS), Pillar Two introduces a global minimum corporate tax rate of 15% for Multinational Enterprise (MNE) groups with revenues exceeding €750 million. The module analyzes how domestic top-up taxes, Income Inclusion Rules (IIR), and Undertaxed Profits Rules (UTPR) impact multinational structuring in India.
3. Upcoming Phase: Procedural Part Pending
With 80% of the syllabus complete, the upcoming final phase of the DT May/Nov 2027 batch will cover procedural and operational mechanics:
- Assessments & Reassessments (Sections 143, 144, 147 to 151): Standard assessment protocols, income escaping assessment, and time limits.
- Appeals & Dispute Resolution (Sections 246A to 264 & Section 144C): Appeals before CIT(A), ITAT, High Court, Supreme Court, and references to the Dispute Resolution Panel (DRP).
- Search, Seizure & Impounding (Section 132 & 133A): Statutory search guidelines, requisition of books, and block assessment concepts.
- Penalties & Offences (Section 270A): Distinction between under-reporting and misreporting of income and statutory immunity provisions.
4. Key Takeaways Checklist for Practitioners & Students
- Verify DTAA Eligibility: Ensure non-resident clients possess a valid Tax Residency Certificate (TRC), Form 10F, and a No-Permanent Establishment (No-PE) declaration.
- Evaluate SEP Thresholds: Review cross-border digital contracts to check if revenue exceeds ₹2 Crore or user engagement surpasses 300,000 in India.
- Maintain Transfer Pricing Documentation: Audit internal intercompany agreements and guarantee benchmark studies are finalized before issuing Form 3CEB.
- Monitor Pillar Two Alignments: Assess MNE group constituent entities in India for global minimum tax compliance and potential top-up tax liabilities.
- Complete Module Revision: Focus on International Taxation theory and practical illustrations immediately while awaiting procedural law uploads.
5. Practical Impact Summary for CFOs and Tax Leaders
